Tenants may be owed overpaid rent under new ruling

The Darwin Community Legal Service says thousands of renters could be in line for compensation due to a legal ruling earlier this month.

The Commissioner of Tenancies has ruled it is illegal to increase the rent on a property during an existing lease, unless the renter had previously agreed to allow for increases.

That could mean that tenants who have had contracts modified - without prior agreement - are now owed overpaid rent.

Katelin Perry has told ABC1's Stateline people should contact the organisation to see if they qualify for a rebate.

"We won't be able to individually assist every tenant but we're certainly happy to provide information about how tenants who have been subject to unfair rent increases can go about making claims of compensation," she said.
